A DUBLIN man with more than 50 previous convictions was jailed for five years at the Central Criminal Court after pleading guilty to having sex “under false pretences” with a woman after a burglary at her home.

Derek Stanley (33) of Dominic Street pleaded guilty to the burglary and procuring sexual intercourse with a woman on the same date on October 20th, 2007. The State entered a nolle prosequi in respect of a more serious charge.

Mr Justice Barry White, who described the offences as “opportunistic”, imposed a five-year sentence for the burglary and a two-year prison term for the offence of having sex with a woman under false pretences. He ordered that both sentences run concurrently.

He said his “hands were tied” with the procurement offence, as the maximum penalty under current legislation was two years.

Deirdre Murphy, prosecuting,said Stanley returned to the victim’s home after the burglary and entered her bedroom. He “got into bed behind her” and they began having sexual intercourse.

The court was told the victim initially believed the man to be her partner. When she realised it wasn’t, she threw him off her. He invited her to continue having sex when she asked him to leave. He left the scene after the victim went to a neighbour’s to raise the alarm.
