A Waterford man has been jailed for eight years for the manslaughter of a friend. In July, a jury acquitted him of murder when it accepted a defence of provocation caused by reminders of past sexual and physical abuse.
Mr Justice Carney said he was taking into account the family's suffering, but that he was bound by the jury's verdict.
Francis Hogan (35) had been acquitted of the murder but found guilty of the manslaughter of Seamus Tubbritt (39), formerly of Pearse Park, Waterford, on December 9th, 1997.
Mr Tubbritt was lying on a sofa as he stayed overnight at the house at Ardmore Park, Ballybeg, Waterford in which Hogan was a lodger. He died from a single stab wound to the heart.
Mr Justice Carney imposed a sentence of eight years, to date from December 1997.
