Mr Horgan was previously charged with assault causing harm to Mr Cegielka who died at Cork University Hospital on April 19th last.

Mr Cegielka failed to regain consciousness after being assaulted and a postmortem by Deputy State Pathologist Dr Michael Curtis found that he had suffered serious head injuries.

Yesterday, Insp McPolin said that the DPP had directed that the assault charge and another charge of producing an offensive weapon laid against Mr Horgan both be withdrawn.

He said that gardaí were seeking a remand in custody. Judge Tim Lucey remanded the accused in custody to appear at Cork Circuit Criminal Court on November 8th next.

Mr Cegielka had been in Ireland for a number of years and was living at the Simon Shelter at Anderson’s Quay in Cork city centre at the time that he was fatally assaulted.
