His condition was described last night as stable.

Det Garda Pat Whelan gave evidence of arresting and formally charging Mr Kelly in connection with the shooting at Roxboro Garda station yesterday.

The court heard that Mr Kelly replied, “I have nothing to say”, in response to the charge.

Judge Tom O’Donnell said the case would require directions from the Director of Public Prosecutions and reserved the question of free legal aid.

The court heard that the State would be objecting to bail.

Solicitor Turlough Herbert said his client was not making a bail application yesterday.

Judge O’Donnell remanded Mr Kelly in custody until November 5th, when he is due to appear before Limerick District Court via video link from Limerick prison.

Judge O’Donnell ordered that the State be informed in advance if Mr Kelly intended to apply for bail on that date and said that arrangements would then be made to have the accused present in court.

Mr Kelly is a younger brother of former Limerick city alderman Michael Kelly, who was elected to Limerick City Council in 1999 after securing the highest number of votes in his electoral area.

The councillor died in 2004 at the age of 48, a number of weeks after he sustained gunshot wounds to the head.
