Disgraced solicitor Michael Lynn will give evidence via video-link from Britain in a case being taken by one of his former clients against First Active over the collapse of a building group.
Mr Lynn is due to testify, in mid-October by video link, in a €310m lawsuit involving lender First Active and multi-millionaire property developer Brian Cunningham.
Mr Justice Frank Clarke was informed when the matter was mentioned briefly before today’s sitting of the High Court by counsel for the Cunningham group, that Mr Lynn will testify via a live video-link from a location at Covent Garden in London.
The court was previously told that Mr Lynn was prepared to give evidence, which is expected to be heard over three days, from the Hungarian capital, Budapest.
Mr Lynn was due to commence his evidence on October 7th, however counsel said there were reasons not to hear the evidence that day, including the fact that the Four Court’s video link facilities may be required for another case and that it was Mr Lynn’s birthday.
It was proposed that Mr Lynn would take the stand on Friday, October 10th, and on the following Monday and Tuesday.
Granting the request Mr Justice Clarke, noted that October 10th was in fact his own birthday. The judge remarked that it was “as good a day as any” to commence hearing Mr Lynn’s testimony.
The judge said it was “hardly surprising” that Mr Lynn did not want to return to testify in person, given that he was in contempt of court for failing to appear in court last year and that he could be the subject of a Garda investigation if he returned.
