Judgment was reserved in the High Court yesterday on whether the captain of a rugby team who was injured in two matches seven years ago was in fact a member of the club and, if he was, whether he can sue the club for damages. Mr Justice Morris said he would give his judgment on the preliminary issues raised during the hearing of the personal injuries action next Tuesday.
When the action opened on Thursday the court was told that Mr Barry Walsh (28) received head injuries when playing for Bandon Rugby Club, Co Cork, on March 25th, 1990, and April 12th, 1990.
During the two-day hearing of the issues the court was told that Mr Walsh had suffered substantial brain damage and had to be taught how to walk again. He also had a speech impairment.
