A HIGH Court judge yesterday ordered a Dublin construction company to return two JCBs it had acquired under a lease agreement.
Mr Justice John Hedigan ordered that Limestone Construction and its director Colm McNulty, Kilreesk Lane, St Margaret's, Co Dublin, "deliver up" two JCB teleporter units which it acquired through a lease agreement with Lombard Ireland Ltd.
The High Court was told Lombard was seeking the orders compelling Limestone Construction to return the JCBs because of concerns they have been removed from the country. Lombard became concerned about the location of the JCBs after agents acting for it contacted Mr McNulty this month and were told that the JCB units were being shipped to Dubai.
The court heard that Limestone Construction had been working on the Titanic Project in Belfast.
Mr Justice Hedigan said that he was satisfied to make an order against Limestone to return the JCBs. Limestone was not represented, nor were any representations made on their behalf.
The court was told that as part of the agreement the defendant acquired the two units in March 2007, and was to make monthly payments, but was in arrears. Lombard claims €143,000 was owed.
