A judge, concerned about complaints of back pain by a 12 year old boy who broke his leg in a fall, has adjourned consideration of a £17,500 settlement offer in the case until he receives further medical clarification.
Mr Paul Murray, counsel for Nassir Hussain, Gracepark Heights, Drumcondra, Dublin, said he was prepared to recommend acceptance of the proposed settlement on the basis of the boy's leg injury.
"But recently the boy has been complaining about back pain and tests revealed a genetic fracture which one medical opinion suggests might never have become symptomatic but for the fall," Mr Murray said.
The Circuit Court President, Mr Justice Spain, said the matter was a potentially very serious one for the boy and he adjourned the case for further expert medical opinion.
