The trial of a Dublin man accused of IRA membership was adjourned at the Special Criminal Court yesterday after the court was told the High Court had made an order preventing it from going ahead.
Mr Anthony Duncan (26), single and unemployed, of Kippure Park, Finglas, Dublin, is charged with IRA membership on April 12th. Mr Felix McEnroy, his counsel, said Mr Justice Carney had granted an application for an inquiry into Mr Duncan's continued detention and there was also a second judicial review application before the High Court.
Mr McEnroy said the judge had also granted a stay on criminal proceedings going ahead in the Special Criminal Court.
Mr Shane Murphy, for the State, said there was no issue that the High Court had granted a stay on the proceedings before the court. Mr Justice Barr remanded Mr Duncan - in custody until January 14th.
