Settlement of 2.5m for boy in hospital case

A young boy with cerebral palsy has secured €2.5 million in settlement of his High Court action over alleged negligence in the circumstances of his birth at the National Maternity Hospital in Dublin. The settlement was made without admission of liability.

The case against the hospital at Holles Street was taken by Gary Smith, now aged 11, through his mother Siobhán Smith, Ely Crescent, Firhouse, Dublin 24.

Recommending approval of the settlement yesterday, Denis McCullough for the child, said the umbilical cord was tight around the baby’s neck at birth and was effectively strangling him, causing near total hypoxia (lack of oxygen) and had to be cut.

Mr Justice Paul Butler approved the settlement and was told Gary would be taken into wardship.

Bogus charity collector fined €63

A judge has called for stiffer penalties for bogus charity collectors who undermine the public’s trust in genuine collectors.

Judge Mary Fahy imposed the maximum fine of €63 on Noel Sweeney (37), of Maigh Riocaird, Galway, who pleaded guilty to collecting money for the Lapland Appeal Fund while not being authorised to do so last October 16th outside a shop at Newcastle Road, Galway.
