Rockwell Constructions has examiner appointed in High Court
A High Court judge has appointed an examiner to Rockwell Constructions Ltd of Macroom, Co Cork.
Mr Justice Peter Kelly said he was satisfied the company had a reasonable prospect of survival. The fact the company’s performance recently improved without the involvement of an interim examiner justified his view such appointments were largely unnecessary and costly, the judge added.
The judge last month granted court protection to Rockwell after finding it was insolvent but with a reasonable prospect of survival, on conditions, as a going concern. He refused to appoint an interim examiner after saying such appointments should be the exception, rather than routine.
€2m secured over birth brain damage
A girl who suffered severe injuries and brain damage as a result of alleged negligence during her birth at Tralee General Hospital has secured €2 million in part settlement of her High Court action.
The settlement for Bríd Courtney, now seven, was made without admission of liability by the HSE. Extra payments to meet future care of the child will be assessed later. Mr Justice John Quirke approved yesterday’s partial settlement and adjourned the proceedings for two years.
Born in February 2003, the girl had, through her mother Deirdre, of Killeacle, Ardfert, Co Kerry, brought the action against the HSE.
Liam Reidy, for the child, said her mother was admitted to the hospital on February 24th, 2003. During labour, the hospital’s agents or servants failed to consider dangers associated with a sudden change in foetal heart rate, and failed to deliver the foetus as speedily as possible. This resulted in perinatal asphyxia, causing brain damage, he added.
Man charged over RTÉ break-in
An unemployed man has been charged with breaking into RTÉ's studios in Cork on Monday night while John Creedon was presenting his show on Radio 1, writes Barry Roche.
Kieran Quilligan (34) was charged with entering as a trespasser with intent to commit theft. Judge David Riordan remanded Quilligan from Bakers Road, Gurranabraher, Cork, on bail to appear at Cork District Court on December 15th.
€6.5m judgment over unpaid loans
ACC Bank has secured a €6.5 million judgment order on consent against a businessman over unpaid property loans.
The bank had previously agreed terms of settlement of its proceedings against Richard Walsh, with an address care of Walsh Consulting Ltd, Lapps Quay, Cork.
The terms provided that the bank could apply for judgment against him if the settlement was breached.
