Councillors vote to reverse Gormley order
Councillors in Dún Laoghaire-Rathdown have voted to reverse an order made by former minister for the environment John Gormley after they were warned they could be removed from office if they did not,
writes Fiona Gartland.
The Park Village lands at Carrickmines, close to the M50, had been rezoned to district centre by councillors in the course of drafting the county development plan.
However, an order from Mr Gormley in March 2010 directed councillors to reverse the rezoning.
Developers Tristor Ltd then took a judicial review of the decision and last November the High Court ruled the minister had acted outside his powers. In a roll-call vote last night, 23 councillors voted to change the zoning back to district centre. Richard Boyd- Barrett and Hugh Lewis of People Before Profit abstained.
Zurich gets €16m order over loans
Zurich Bank has secured judgment for more than €16 million on consent against a businessman arising from unpaid loans related to a development in Co Clare.
Mr Justice Peter Kelly entered judgment in that sum yesterday against Donal O'Connor, Clarinbridge, Co Galway. Summary judgment for the same amount was previously entered against Martin Roche, Loughrea, Co Galway.
The proceedings arose after the bank advanced €8.46 million in June 2007 to MJ Roche Construction (Clarecastle) Ltd to finance a commercial development at Clarecastle, Co Clare. A receiver was appointed to the company in July 2009.
Both defendants were directors of that company. The terms of the June 2007 loan required them to provided a joint and several guarantee, supported by security, the bank said.
Restriction orders on brothers sought
The liquidator of a company of brothers Simon and Christian Stokes which operated a Dublin city centre restaurant is seeking High Court orders disqualifying the brothers from involvement in the management of any company, writes Mary Carolan.
Tom Murray, liquidator of Mayfair Properties Ltd, operator of Bang Cafe, wants disqualification orders against the brothers and is also seeking restriction orders against them. Damian Keaney told Ms Justice Mary Finlay Geoghegan yesterday they may "take a certain course" in relation to the restriction orders but the disqualification orders were "a different matter entirely".
Flight diverted over medical emergency
A transatlantic jet was forced to divert to Shannon airport last night after a baby became ill on board.
The 13-month-old girl is understood to have suffered a number of seizures about three hours after the flight on which she was travelling departed from the US.
The British Airways flight was en route from Logan airport in Boston to London Heathrow when the captain contacted air traffic controllers to advise them of the emergency. The crew requested permission to land and asked that emergency medical services be on standby. The baby was taken to the Mid Western Regional Hospital, where she received treatment last night.
Retrial ordered in sex assault case
The Court of Criminal Appeal has quashed the conviction of former Irish Olympic swimming coach Gerard Doyle for sexually assaulting five young boys and ordered a retrial.
Doyle (50), of Emmet Place, Wexford, was sentenced to six-and-half years in prison by Judge Alice Doyle in January last year, having been found guilty of 34 counts of indecent assault and one count of sexual assault by a Wexford Circuit Criminal Court jury.
The three-judge appeal court found that the judge had erred in her delivery of a delay warning to the jury.
