The High Court has reserved judgment in an action for damages taken by a Dublin couple over the demolition of the house next door to their home in Howth, Co Dublin.
Mr Ultan and Ms Fionnuala Todd of Quinton, Grey's Lane, Howth, are claiming the house adjoining their home was demolished in 1995 without appropriate planning permission and that the demolition had structurally and aesthetically damaged their home, leaving extensive cracks and dampness. Mr Todd, a company director, and his wife, a teacher, sued Mr Bruno and Ms Concetta Cinelli, Kilbarrack Road, Sutton; Newtown Developments Limited, Tudor Avenue, Cypress Downs, Templeogue; Breffni Plant Hire Limited, Magenta Hall, Santry; Rafaele Cavallo, The Grove, Bettyglen and Paul McMahon of Daleview Road, Swords, Co Dublin.
