A 15-year-old girl who gave oral sex to two older boys was adamant she did not want her parents notified after she claimed one of the youths had raped her.
Garda Michelle Gethings told a Central Criminal Court jury the girl was "inconsolable" in the Garda station after the alleged rape on October 17th, 1997. She kept repeating she would be in trouble if she stayed out late.
She was advised to see a doctor as soon as possible and to think about making a formal complaint which the Garda would investigate. She lodged a formal complaint some weeks later.
The now 19-year-old youth has pleaded not guilty to raping and sexually assaulting the girl on October 17th, 1997, beside St Raphaela's Convent, Upper Kilmacud Road, Stillorgan.
Garda Gethings told Ms Miriam Reynolds SC, prosecuting, that the girl and her friend were crying when they came to the Garda station on October 17th, 1997. Before they left at 12.40 a.m., the girl related the night's events in pieces. She said she had gone voluntarily into the bushes with the accused and had been involved in oral sex before he raped her.
The accused youth's statement said he did not have intercourse with her. A forensic scientist told the jury that no traces of semen were found.
The hearing continues before Mr Justice Carney.
