The Supreme Court has al lowed the Garda authorities to proceed with disciplinary proceedings against a trainee garda alleged to have exposed him self while impersonating singer Tom Jones six years ago.
Garda Brian McAuley (27), of Kempton Way, Navan Road, Dublin, failed in his appeal against a High Court ruling last year that the Garda authorities were entitled to take disciplinary proceedings against him.
The incident is alleged to have taken place at Allen's licenced premises, Templemore, Co Tipperary, on October 13th, 1993. Garda McAuley is alleged to have indecently exposed himself and assaulted a female trainee.
He denies exposing himself or opening his trousers' zip, lowering his trousers or interfering with his underclothing. He had sung It's not Unusual and, as he returned to his place, he had lifted the front of his T-shirt and placed it over a female trainee Garda's head. It was claimed Garda Mc Auley was confined to duties in the print room at Templemore Garda training centre until his appeal was determined. It was unanimously rejected.
