An early video featuring a performance by three members of chart-topping boy-band Westlife is to be the subject of a case before Sligo Circuit Court.

The video was made four years ago when three of the members of Westlife were in a Sligo-based group known as IOU. Following a court injunction preventing it from being circulated, the video is now being held in a bank in Sligo.

None of the three members of Westlife featured in the video - Shane Filan, Kian Egan and Mark Feehily - are directly involved in the case.

The action is being taken by three members of a Sligo-based company, Streetwise Promotions, who claim they had an agreement with the defendant to make a video of a performance by the band in September 1997.

They are alleging the defendant, Ciaran Carthy, failed to supply the master tapes and copies and are suing for £30,000.

Counsel for the plaintiffs, Mr Stephen Byrne, said they would be concerned about a long delay in hearing the case because the value of the tapes could fluctuate as the boy-band members got older.

Judge Bryan McMahon said he believed they should have "more confidence" in the band members and unless there was "an extraordinary situation" the value would not fluctuate in a couple of months. The case was put back until March 5th.
