EVENTS leading up to yesterday's eviction attempt at a Co Cavan farm began two years ago.
Ballyconnell District Court made an order for the possession of the house in favour of owner, Mr Michael Hehle, in July 1995.
Mr Gerrit Isenborger had no legal representation a this hearing, Mr Hehle's, solicitor, Mr Gabriel Toolin, said last night.
Mr Toolin said Mr Isenborger subsequently hired a solicitor and appeared at the Circuit Court in Cavan in March last year to appeal to possession order.
The District Court order was affirmed by the Circuit Court and Mr Isenborger was given a stay of three months.
According to Mr Toolin, the June deadline passed and numerous requests were made for Mr Isenborger to leave, but he did not. Mr Toolin said he handed the Circuit Court order for possession to the county registrar for execution last June. The sheriff in Cavan was then authorised to take possession of the property.
Mr Toolin said Mr Hehle and the Co Cavan registrar, Mr Thomas Owens, extended the deadline for Mr Isenborger's departure between four and six limes. He said it was understood that Mr Isenborger was prepared to leave on several occasions.
"His major reason for staying, was that his mother was ill and for that reason everybody was extremely lenient and sympathetic," said Mr Toolin.
According to Mr Toolin, Mr Isenborger was given a final deadline to leave the premises on January 8th. "It was hoped that he would get out but he didn't and then it came to this," he said.
