The lead singer with a rock group, who dislocated a fan's shoulder when he dived off the stage to "surf" the crowd, cost a concert promoter thousands of euro yesterday.

Art student Mr Stephen O'Shea, who sued MCD Management Services Ltd., Park Road, Dún Laoghaire, for €38,000 damages, settled his claim in the Circuit Civil Court for an undisclosed amount.

Mr O'Shea, from Aubrey Road, Glengoole, Thurles, Co Tipperary, had claimed that in January, 1998, when he attended a concert by the group, Deftones, in the SXF Hall, Upper Sherrard Street, Dublin, the lead singer, Chino Moreno, dived from the stage into the crowd.

Mr O'Shea, who is also a guitarist and beach lifeguard, had alleged Moreno climbed onto the public address system on stage and dived off the stage to surf the crowd.

Moreno had struck Mr O'Shea dislocating his left shoulder.

Mr David Nolan, counsel for MCD Management Services Ltd., told Judge Bryan McMahon that the claim had been settled following talks and could be struck out with an order for taxation of Mr O'Shea's costs. Mr O'Shea, who is now aged 25, had claimed he had previously suffered dislocations of his left shoulder on several occasions, the most recent having been in 1994 when he had fallen while playing soccer.

He had been taken by ambulance to the Mater Hospital, Dublin, where his shoulder had been put back in place.

Since the injury he had experienced pins and needles in his left hand fingers which affected his guitar playing.

Although the settlement was not disclosed in court, it is believed to run to five figures.
