The High Court has granted a judicial review of a decision of the Employment Appeals Tribunal concerning a Louth-based furniture importing company known as Furniture Link International, writes Carol Coulter.
In January last, the tribunal awarded a member of the company's sales staff €35,000 for constructive dismissal, and found it had failed to act reasonably in its dealings with Carmel Byrne, Lindisfarne Avenue, Bawnogue, Clondalkin.
The company appealed the decision to the High Court, which quashed the decision of the tribunal on January 21st. The decision of the court was not contested and on April 21st Mr Justice Peart issued the order.
Mulhall mother sent for trial
Kathleen Mulhall has been sent forward for trial to the Central Criminal Court on charges arising from the killing of her boyfriend Fareh Swaleh Noor.
The 54-year-old, with an address at St Mary's Park, Carlow, faces nine charges: that she withheld information, helped clean up a crime scene, five counts of giving false information over Mr Noor's whereabouts, and two counts of pretending she did not know his whereabouts.
Mrs Mulhall's daughters Linda and Charlotte are serving sentences for killing Mr Noor whose dismembered remains were found in the Royal Canal in Dublin in 2005. At the Dublin District Court yesterday Mrs Mulhall was granted legal aid for two counsel. Her case will now take its place in the court's list and could be heard by the end of the year.
Man on trial over road fatality
A man has gone on trial at Dublin Circuit Criminal Court accused of dangerous driving causing the death of an elderly man in Dublin in 2006.
Lithuanian Romas Petrosius (24), Grosvenor Square, Rathmines, Dublin, has pleaded not guilty to dangerous driving causing the death of Thomas Kealy at Dolphin's Barn Bridge, Rialto, on May 20th, 2006.
Michael Bowman, prosecuting, said the jury would hear evidence from witnesses that Mr Kealy was attempting to cross the road when as a result of an incident he rolled under a moving car and died later that day from his injuries.
The trial continues.
Slapped child awarded 5,000
A child, who was slapped by a hospital nurse for switching on and off a bedside light, has been awarded damages of €5,000 in the Circuit Civil Court.
Counsel for Anthony Reddington John Doherty, said the assault had taken place when the boy, then aged 12, was being treated in the Royal Victoria Eye and Ear Hospital, Dublin, for a serious eye injury. He said the nurse had struck the boy on the shoulder leaving a noticeable red mark. She had later been reprimanded following a hospital inquiry.
Four remanded in republican case
Four men arrested during a Garda operation into the activities of dissident republicans in Co Donegal last month were further remanded after a brief appearance at the Special Criminal Court in yesterday.
All four men have addresses in Derry City. They are: Gary Donnelly (38), Kildrum Gardens; Michael Gallagher (28), Sackville Court; Martin Francis O'Neill, Colmcille Court, and Patrick John McDaid (39), Marlborough Street.
