Dublin man on firearm charge is granted bail

A DUBLIN man charged with intent to intimidate using a firearm or imitation firearm was granted bail by Dublin District Court yesterday evening. A second man charged with assault was also released on bail at the same hearing.

Mr Noel Kirwan, of Sean O'Casey Avenue, pleaded not guilty to having a firearm or imitation firearm with intent to intimidate a person at Ballybough Road on September 17th.

Mr Donal Fennelly, of Ballybough House, made no response to the charge of assault of Mr Philip Carter at St Joseph's Mansions on October 5th.

The court was told that Mr Kirwan was arrested on Monday morning at Sean O'Casey Avenue under Section 30 of the Offences Against the State Act, and Chief Supt Richard Kelly of Fitzgibbon Street station said he signed an order for extended detention yesterday morning.

A lawyer for Mr Kirwan, Mr David Keane, said that, while his client was charged, he still appeared to be detained under Section 30. This was inappropriate and he should be released. Mr Michael O'Higgins, defending Mr Fennelly, told Judge William Hamill the same argument was relevant in the case of his client.

After a short recess the judge said the two men were properly charged. Mr Kirwan was released on bail of £500 and an independent surety of £1,500. Mr Fennelly was granted bail of £500 and an independent surety of £1,000.

Both men are to appear before Dublin District Court next Tuesday.
