Dublin man loses damages claim over fall in Dunnes Stores

A man who fell over a child’s buggy in a Dunnes Stores shop has lost a damages claim against the company.

A man who fell over a child’s buggy in a Dunnes Stores shop has lost a damages claim against the company.

Michael Kirwan (32), Mourne Road, Drimnagh, Dublin, told the Circuit Civil Court that on April 24th, 2009, he had been in the hardware section of Dunnes Stores at Ashlea Shopping Centre at Crumlin Cross. He said he tripped over the buggy and hit his forehead. He had stood up, become dizzy and fallen backward, hitting the back of his head. Mr Justice Matthew Deery said the buggy’s location in an aisle did not constitute a negligent act by the store.
