Girl awarded €65,000 over fall on Dublin city pavement

A girl who fractured her shin bone after falling on a footpath has secured a €65,500 settlement of her High Court action against Dublin City Council.

Megan Lee was 12 when on November 5th, 2012 she went over on her ankle in a depression on the path. She sustained a nasty fracture to her shin bone as a result, her counsel Michael Byrne said.

Ms Lee was on crutches for a number of months and had screws inserted in her foot and a later operation to take the metal out, he said. She also had a limp for a time.

Now aged 17 and a fifth-year student, she is a “terrific” young girl, he said.

Ms Lee of Windmill Avenue, Crumlin, Dublin, sued Dublin City Council, through her mother Joanne Zambra Lee, as a result of the accident at Agnes Road, Crumlin.

It was claimed that work had been carried out on the road and an alleged defective reinstatement caused a pavement depression. It was also alleged there was failure to have the depression highlighted adequately or at all and to ensure the pavement was even and safe for pedestrian use.

The council denied the claims.
