A company in which developer Séamus Ross is a director has lost its High Court bid to avoid a VAT liability of almost €3 million related to two developments in Co Dublin.

Andiamo Properties, in which Mr Ross and Michael Keogh are directors, disputed the Revenue’s rejection of its case that a scheme set up by Andiamo and a related company, Drumloe Properties, had the effect of avoiding VAT liability on proceeds from site sales at developments at Taylor’s Hill, Rathfarnham, and Applewood, Swords. The Revenue issued a VAT assessment of €2.93 million to Andiamo in 2005 after saying it did not agree the complex arrangements entered into between the two companies had the effect of avoiding a VAT charge.
