A seven-year driving ban and £500 fine imposed on a lorry driver, convicted of having driven without insurance, has been overturned in the Circuit Court. Mr Ross Maguire, counsel for Robert Heaton (23), of Cushlawn Park, Tallaght, told Judge Dominic Lynch that his client had been charged in the District Court in December 1993.

When he had inadvertently failed to appear in court a warrant for his arrest had been issued and four years later he had been brought before the court and fined and banned.

Judge Lynch upheld Mr Maguire's submission that the inordinate delay in executing the warrant had breached Mr Heaton's constitutional rights.
