THE case being taken by objectors to the £35 million five-star Hilton Hotel off College Green, Dublin, resumed yesterday in the High Court on a preliminary issue.

In the main action, the objectors, a number of conservationists who have formed a company called Lancefort Ltd, Ormond Quay Upper, Dublin, are seeking leave to take a judicial review challenging the project for the 167-bedroomed hotel on the site.

It is also taking the action on constitutional grounds.

The company is taking the case against An Bord Pleanala, the Minister for the Environment and the Attorney General. Treasury Holdings, the developer, is a notice party.

Yesterday, the hearing resumed before Mr Justice Morris on a preliminary point. The State and Treasury Holdings are contending that the company does not have standing to take the case.

In order to take any action, a plaintiff must establish that it has a sufficient interest in the subject matter of the litigation to pursue the claim.

If the court establishes that a plaintiff does not have sufficient interest, it will not be entitled to proceed.
