A councillor is challenging a decision by Fingal County Council on March 26th last approving a variation in the 1993 Dublin county development plan in respect of lands adjoining James Connolly Memorial Hospital, Blanchardstown, the High Court heard yesterday.

Mr Sean Lyons, of Coolmine Woods, was given leave to seek judicial review of the decision and to seek an order directing Fingal County Council to reconsider a request by the Eastern Health Board (EHB) for a variation of the plan.

Mr Lyons also wants an order directing the council to exclude any of its members who are also members of the EHB from any reconsideration, discussion or decision in relation to the EHB's request for a variation of the plan in respect of the lands.

In an affidavit, Mr Lyons, an elected member for the Castleknock area, said that in the development plan the lands concerned were zoned to protect and provide for the development of agriculture.

The lands also carried specific development plan objectives, inter alia to protect and provide institutional uses in open lands to protect and preserve trees and woodlands.

Four members of the council are also members of the EHB.
