A Drogheda gynaecologist and a hospital today failed in a Supreme Court appeal in the case of a mother who alleged her womb was unnecessarily removed following the birth of her child.

Dr Michael Neary and Our Lady of Lourdes Hospital in Drogheda appealed against the High Court's decision in the case of Ms Alison Gough, (37) of Market House Lane, Ardee, Co Louth.

His appeal on the basis that Mrs Gough's legal action against him and the hospital was outside the time limit for taking a case was rejected by a two-to-one majority in the Supreme Court.

The court reduced the High Court's award of €273,233 damages by €50,000.

In the High Court ruling, Mr Justice Johnson ruled that Dr Neary was negligent in his treatment of Mrs Gough at the time of the birth of her only child in October 1992.

He said that, had Dr Neary carried out certain procedures on Mrs Gough, it would not have been necessary to remove her womb shortly after the birth.
