A settlement has been reached in the High Court in a case in which the family of the late composer, Sean O Riada, brought copyright proceedings against both RTE and Naxos Records.
Ms Fidelma Macken SC, representing the O Riada family, told Mr Justice Geoghegan yesterday that certain undertakings had been given by both defendants before the case was due to resume yesterday.
These undertakings, which were not revealed, were handed into court and the case was struck out on foot of them.
The O Riada family claimed there had been infringements by RTE and Naxos in regard to one of their father's compositions.
This composition, The Banks of the Sullane, had been recorded by the RTE Sinfonietta as part of a Naxos CD entitled Romantic Ireland.
The O Riada family claimed it owned the copyright to the music and said it had never given permission for such a recording.
