An Austrian businessman who claimed he did not know he was made a party to legal proceedings over a Donegal fishery yesterday lost his Supreme Court appeal against a High Court order that he pay legal costs.

Mr Helmut Longin, who owns a 35 per cent interest in Cloghan Lodge Hotel, Letterkenny, claimed he had not instructed Mr Patrick A. Dorrian, a solicitor, of Buncrana, or his firm to act on his behalf in legal proceedings - concerning overfishing of a fishery.

After a series of court hearings costs were awarded against Mr Longin following a 1995 High Court decision. Mr Longin appealed the finding to the Supreme Court.
