TENANCY CASE:A man who cared for his late grandmother has lost a High Court case aimed at overturning Dublin City Council's decision requiring him to leave her council house.

Jason Robinson moved in with his grandmother, who suffered from Alzheimer’s disease, at St Michan’s House, Greek Street, Dublin, in 2005 and looked after her until she died in June 2008.

He then applied to take over her tenancy but was refused and in late 2008 he was served with a notice to quit the property.

Mr Justice John Hedigan dismissed Mr Robinson’s action on grounds it was brought “far outside” the applicable time limits.

The respondents had argued Mr Robinson delayed in bringing his High Court proceedings and was not entitled to the reliefs sought. They claimed he was informed of the decision to quit in January 2009, but did not start his High Court action until May 2009.

The judge said proceedings challenging the notice to quit must be brought as quickly as possible.

No explanation was given, other than Mr Robinson had continued to engage with the housing authority in relation to the tenancy, he added.
