The Supreme Court has upheld a High Court decision on a proposal to locate a landfill waste disposal site at Ballynagran to serve north east Wicklow.
Wicklow county councillors voted 14 to five in July 1994 to reject a consultants' proposal to site the dump at Ballynagran and called for other sites to be investigated.
In August 1994, East Wicklow Conservation Community Ltd, a conservation group, was granted leave in the High Court to apply for an order to quash the county manager's refusal to comply with the elected councillors' July resolution.
The relief sought was refused by the High Court and that refusal was appealed to the Supreme Court.
