THE Supreme Court yesterday dismissed an appeal against a High Court decision last year ordering a director of Greendale Developments Ltd, in liquidation, to pay the liquidator on behalf of the company a sum of over £430,000.
When the case was before the High Court, the President, Mr, Justice Costello, said the application was brought by the official liquidator against Mr Stephen Fagan, a director of the company, and his wife, a shareholder.
The liquidator was seeking repayment of a total of £302,387 representing, he claimed, money paid by the company for the benefit of Mr and Ms Fagan; transfer to the company by Mr and Ms Fagan of property known as Springfield, Churchtown Road, Dublin, or alternatively, payment of a sum of £129,714 paid by the company for the Fagans' benefit in relation to the purchase by them of that property.
"The High Court ordered Mr Fagan to pay to the liquidator on behalf of the company the sum of £435,750. He made no order against Ms Fagan, since she was not an officer of the company.
