The Justice Department and 19 states that brought the antitrust case against Microsoft are expected to ask an appeals court today to uphold findings that the company violated the law and should be broken in two.

The government brief to the US Court of Appeals will respond to Microsoft's written arguments in November that said the lower court proceeding was "infected with error".

District Judge Thomas Penfield Jackson found Microsoft held monopoly market power for personal computer operating systems.
