Two youths appeared at a special sitting of Limerick District Court at the weekend charged in connection with the death of a 43-year-old school teacher, who died after a vicious assault.
A native of Ballingarry in Co Limerick, Mr Noel Carmody died at Limerick Regional Hospital early on Saturday morning after an assault at Arthur's Quay Park in the city which took place shortly after 4.30 a.m.
Yesterday evening, Mr Jonathan Tuohy, (19), of Edward Street, Limerick and Mr Darren Wallace, (20), of Asumpta Park, Lee Estate Limerick were both charged with assaulting Mr Noel Carmody causing him harm contrary to Section 3 of the Non-fatal Offences Against the Person Act.
Det Sgt Eamon O'Neill said Mr Tuohy was allegedly seen by two gardaí beating the injured party with an iron bar.
The Det Sgt also alleged that Mr Tuohy's co-accused Mr Wallace was seen "crouched over" the deceased when gardaí arrived.
The State said they feared both of the accused might flee the area if bail was granted.
Defence solicitor for Mr Tuohy, Mr Ted McCarthy said his client was in "very poor financial circumstances" and there would be no danger of him fleeing the country if granted bail. Defence solicitor for Mr Wallace, Mr John Devane, said his client would comply with any bail conditions imposed by the court if bail was granted.
Judge Tom O'Donnell refused bail for both of the accused because of the "seriousness of the charge" and remanded both men in custody until October 1st next when they are due to reappear before Limerick District Court.
A native of Ballingarry in west Limerick, Mr Carmody had moved into Limerick city centre in recent years.
He had worked as a school teacher but was not working in that role at the time of his death. He is survived by a brother and a sister.
