Defeated Labour Party candidate in Wicklow, Mr Nicky Kelly, has decided to withdraw his challenge to the outcome of the 2002 General Election.
Mr Kelly was challenging the result of the election in Wicklow on the basis of an alleged overspend by the Fianna Fáil TD, Mr Joe Jacob.
However, in a statement today Mr Kelly said: "Having discussed with my legal team the implications of the decision given in the High Court today by Mr Justice Peter Kelly in the Kathy Sinnott case, I have decided not to proceed with the case I had initiated".
"As I missed out on a seat in Wicklow by a margin of only 19 votes, I believed that it was in the public interest to initiate this case," he added.
Ms Sinnott, a disability campaigner in Cork South Central, heard in the High Court today she had failed to demonstrate the Minister for Health, Mr Martin, overspent during campaigning.
Ms Sinnott - who lost the election by six seats after a recount - had brought a petition, along with Mr Mark Menihane, an elector in Cork South Central, to the High Court.
