A former male nursing assistant, who wrenched his back while holding up a patient, has settled his €38,000 damages claim against the nursing home.

Mr Tony McKeown, counsel for Mr Jonathan Dunne, of St Begnets Villas, Dalkey, Co Dublin, told the Circuit Civil Court his client had injured his back while assisting a nurse perform what should have been a three-person task.

The accident had occurred in June 1998, when he had been directed by the nurse in charge to assist her in lifting the patient, a heavy stroke victim, out of a sofa-like chair onto a commode.

Mr Dunne had sued E.J. Packenham, Edward M. Packenham and Breda Packenham, joint owners of Carysfort Nursing Home, Arkendale Road, Glenageary, Co Dublin, for negligence.

Mr Paul Murray, counsel for the defendants, said his clients had entered a full defence. Following a recess, Judge Smyth was told the case had been settled. The settlement figure was not disclosed.
