The Oireachtas committee investigating Judge Brian Curtin said today it would be continuing its work despite claims that the judge is too ill to take part.
The committee met today to consider submissions from the Tralee judge's legal team on the state of his health.
In a short statement, it said it had considered the submisssions but was "now proceeding with its work and with the implementation of the Orders of the Houses of the Oireachtas which established it".
The members of the Committee are Mr Denis O'Donovan (chairman), Mr Jerry Cowley, Mr Jim O'Keeffe and Ms Jan O'Sullivan, and Mr John Dardis, Ms Geraldine Feeney and Mr Michael Finucane.
Members of the committee spent yesterday trying to establish whether the judge's health is good enough for him to engage with them in a meaningful way, either in person at a hearing, or through lawyers.
The committee now faces possible legal challenges to its continuing work.
Judge Curtin has been asked to explain how he came to be charged with the possession of child pornography, of which he was acquitted last April, and the committee is due to report back to the Oireachtas.
