The case against 12 of 25 anti-waste-charge protesters will be heard tomorrow after 13 of them today undertook at the High Court not to break the terms of an injunction preventing them from interfering with the collection of bins.

Mr Justin McQuaid SC, counsel for 24 of the protesters told Mrs Justice Carroll that 13 of the respondents would give an undertaking not to break the terms of an injunction preventing or impeding Dublin County Council bin collections in its area.

Mrs Justice Carroll excused the 13 respondents - who apologised to the court - but warned them of the serious consequences of being found in contempt of the injunction after giving an undertaking to the High Court to abide by it.

The case against the other twelve before the court will proceed tomorrow at 10.30 a.m. and Mrs Justice Carroll told them to "think very carefully overnight about their attitude". She repeated her advice at the end of the today's hearing.

"The law is there and it must be upheld. I took an oath to uphold the law and that is what I will do. I advise those who break the law of the land to tread very carefully," she added.

Last Friday, Ms Carol O'Farrell, counsel for the Dublin City Council, was granted leave to serve the protesters with short notice of the authority's intent to seek their attachment and committal in the High Court today.

She told the President of the High Court, Mr Justice Finnegan, that 22 of the protesters were from the Finglas area.

The 12 still facing attachment and committal to prison for contempt of court are: Dermot Connolly, Colm Breathnach, Noreen Bradley, Lisa Carroll, Kay Conlon, Anna Doran, Bernie Hughes, Noel Kelly, Maureen Maher, Declan Mahon, Hanna Moore, John O'Neill,.

The 13 who apologised and agreedc to abide by the terms of the injunction are: Margaret Burn, Madeline Casey, Kay Connolly, John Cronin, Jack Grennan, Eithne Grogan, Maria McDonald, Noeleen O'Connell, Thomas O'Sullivan, Geraldine Scott, Christy St Ledger, Jean Walsh and Patricia Walsh.
