AN application to seek to call Mr Larry Goodman to the witness box in proceedings in which he is claiming £22.5 million from a Co Tipperary farmer was adjourned until Friday in the High Court yesterday.
Mr Joseph Kenny wants to make the application to have Mr Goodman cross examined on his affidavit when the main action comes on for hearing.
No date has yet been fixed for the main hearing.
Yesterday Mr Don at O'Donnell SC, for Mr Goodman, opposed the application, stating that Mr Kenny had given no evidence or explanation as to what was in dispute and why he wanted to cross examine Mr Goodman.
Dr Michael Forde SC, for Mr Kenny, said he was entitled to cross examine and did not have to indicate what questions Mr Kenny's team wanted to ask.
Mr Justice Kinlen said Mr Kenny had given no evidence to the court on the matter.
He wanted Mr Kenny to set out in an affidavit all the differences in fact between him and those contained in Mr Goodman's affidavit.
He also wanted a translation of proceedings that had been heard in Cyprus relating to the matter. He wanted these documents by Friday and would adjourn until then.
In the main action, Mr Goodman, First ABP Holdings Ltd, Belfast, UK registered Second Anglo Beef Processors Ltd and Gemon Ltd are claiming that under a loan they advanced to Mr Kenny in March 1990 the money which was due to be repaid before June 13th, 1990, was still owing. Mr Kenny claims the money was never placed in an account.
